1. Definitions and Interpretation

In these Terms and Conditions (“Terms”), the following words and expressions shall have the meanings assigned to them below:

  • “SYLK Skin”, “we”, “us”, or “our” means the trading name SYLK Skin, operated by Naturally Better (Pty) Ltd, with its principal place of business at 51 Fisant Road, Dinokeng Game Reserve, Hammanskraal, 0400.
  • “Website” means the e-commerce website accessible at www.sylk-skin.co.za, including all associated pages, subpages, and content.
  • “Customer”, “you”, or “your” means any natural or juristic person who accesses, browses, registers on, or places an order through the Website.
  • “Order” means a request submitted by you to purchase one or more Products through the Website.
  • “Products” means the cosmetic skincare products listed for sale on the Website.
  • “Bespoke Products” means custom-formulated products created to order based on specific customer requirements.
  • “CPA” means the Consumer Protection Act 68 of 2008.
  • “ECT Act” means the Electronic Communications and Transactions Act 25 of 2002.
  • “POPIA” means the Protection of Personal Information Act 4 of 2013.
  • “PayFast” means the payment processing service provided by DPO Pay S.A. (Pty) Ltd.
  • “The Courier Guy” means The Courier Guy (Pty) Ltd, our designated courier service provider.
  • “Business Day” means any day other than a Saturday, Sunday, or South African public holiday.

References to the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.


2. Acceptance of These Terms

2.1 By accessing or using our Website, creating an account, or placing an Order, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and our Refund and Returns Policy, all of which are incorporated herein by reference.

2.2 If you do not agree to these Terms in their entirety, you must immediately cease using the Website and must not place any Orders.

2.3 These Terms constitute the entire agreement between you and SYLK Skin in relation to your use of the Website and the purchase of Products. They supersede all prior representations, agreements, and understandings between the parties relating to this subject matter.

2.4 We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of the Website after the posting of any changes constitutes your acceptance of the revised Terms.


3. About SYLK Skin

3.1 SYLK Skin is a South African botanical skincare brand trading under Naturally Better (Pty) Ltd, a duly incorporated company under the laws of the Republic of South Africa.

3.2 SYLK Skin’s principal place of business and warehouse is located at 51 Fisant Road, Dinokeng Game Reserve, Hammanskraal, 0400. Due to the nature of our warehouse location, courier collections are scheduled twice per week. This may affect order processing and delivery timeframes (see Section 10).

3.3 Payments made on the Website are processed by PayFast on behalf of SYLK Skin. Your payment confirmation and bank statement may reflect the name of the processing entity associated with Naturally Better (Pty) Ltd.


4. Product Disclaimer

4.1 SYLK products are cosmetic skincare products intended to support skin comfort and hydration. They are not intended to diagnose, treat, cure, or prevent any disease.

4.2 All Products are classified as cosmetics under applicable South African legislation. Nothing on this Website, in our product descriptions, articles, testimonials, or marketing communications constitutes medical advice, a medical claim, or a therapeutic claim.

4.3 Customer testimonials and before-and-after images displayed on this Website reflect individual experiences and results, which may vary. These are not warranties, guarantees, or representations that all customers will achieve the same results.

4.4 Customers with known skin conditions, allergies, compromised immune systems, or other medical concerns are strongly advised to perform a patch test before using any SYLK Product and to consult a qualified healthcare professional before commencing use.

4.5 SYLK Skin shall not be liable for any adverse reactions, skin conditions, or other outcomes arising from the use of our Products, except where such liability arises from our own gross negligence or wilful misconduct, or as required under the CPA.


5. Eligibility

5.1 You must be at least 18 years of age to use this Website or place an Order.

5.2 By placing an Order, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into a binding contract.

5.3 If you are under 18, you may only use this Website under the supervision of, and with the express consent of, a parent or legal guardian who agrees to be bound by these Terms.

5.4 Our Website and Products are intended for personal use and are not intended for resale without our prior written consent.


6. Account Registration

6.1 You may browse the Website without registering an account. However, to place an Order, you may be required to create an account by providing accurate and complete information.

6.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must immediately notify us at info@sylk-skin.co.za if you become aware of any unauthorised use of your account.

6.3 We reserve the right to suspend or terminate your account at our discretion, including where we suspect fraudulent activity, misuse of the Website, or breach of these Terms.

6.4 You may not create an account on behalf of another person or entity without their express authority.


7. Products and Availability

7.1 All Products are subject to availability. We reserve the right to discontinue any Product at any time without notice.

7.2 Product descriptions, images, and ingredient lists are provided for informational purposes and are as accurate as reasonably possible. Actual product packaging, appearance, or formulation may vary slightly from images displayed on the Website due to product improvements or supplier changes. We will endeavour to notify customers of material changes.

7.3 We reserve the right to limit the quantity of any Product that may be ordered per customer or household.

7.4 SYLK Products are manufactured in small batches to maintain quality and ingredient integrity. Stock availability may therefore be limited at any given time.


8. Pricing and Currency

8.1 All prices displayed on the Website are quoted in South African Rand (ZAR) and are inclusive of Value Added Tax (VAT) where applicable.

8.2 We reserve the right to change prices at any time without prior notice. Price changes will not affect Orders that have already been confirmed by us.

8.3 In the event of a manifest pricing error, we reserve the right to cancel an Order even after confirmation, in which case we will notify you and refund any payment received.

8.4 Delivery charges, if applicable, will be clearly displayed at checkout before you confirm your Order.

8.5 SYLK Skin does not accept responsibility for currency conversion costs, international bank charges, or other fees applied by your financial institution.


9. Placing an Order

9.1 To place an Order, add your desired Products to the cart and proceed through the checkout process, providing accurate billing and delivery information.

9.2 By submitting an Order, you make an offer to purchase the selected Products at the indicated price, subject to these Terms.

9.3 An Order confirmation email will be sent to your registered email address upon receipt of your Order. This confirmation is an acknowledgement of receipt only and does not constitute acceptance of your Order by us.

9.4 A binding contract of sale is only formed once we send you a separate dispatch or shipping confirmation email. We reserve the right to decline or cancel any Order at our sole discretion, including in the event of:

  • Product unavailability or out-of-stock situations
  • Pricing errors or manifest errors on the Website
  • Failed payment authorisation
  • Suspicion of fraudulent activity
  • Delivery address outside our shipping area

9.5 You are responsible for ensuring the accuracy of all Order details, including delivery address, product selection, and quantity, before confirming your Order. SYLK Skin will not be liable for Orders dispatched to incorrect addresses provided by the customer.


10. Payment

10.1 All payments must be made in full at the time of placing an Order.

10.2 We accept payments via the methods made available through PayFast, our designated payment gateway, which may include credit and debit cards, instant EFT, and other payment options offered by PayFast from time to time.

10.3 By making a payment, you confirm that you are the authorised account holder or cardholder, or have the authority to use the payment method provided.

10.4 SYLK Skin does not store, process, or have access to your full payment card details. All payment information is processed securely by PayFast under their own terms of service and security standards, which we encourage you to review at www.payfast.io.

10.5 In the event of a failed or declined payment, your Order will not be processed. You may attempt payment again or contact us for assistance.

10.6 SYLK Skin reserves the right to pursue any unpaid amounts by lawful means, including referring the matter to a debt collection service or legal representatives.


11. Delivery

11.1 SYLK Skin delivers within the Republic of South Africa only. We do not offer international shipping at this time.

11.2 Deliveries are fulfilled through The Courier Guy. Due to the location of our warehouse at Dinokeng Game Reserve, courier collections are scheduled twice per week. This means that orders may not be dispatched on the same day or the next day after placement. We appreciate your understanding of this operational constraint.

11.3 Estimated delivery timeframes will be communicated to you at checkout and in your order confirmation. These are estimates only and are not guaranteed. SYLK Skin shall not be liable for delays caused by The Courier Guy, adverse weather, force majeure events, or circumstances beyond our reasonable control.

11.4 A tracking number will be provided to you via email once your order has been collected by The Courier Guy. You may track your order directly via The Courier Guy’s tracking portal.

11.5 It is your responsibility to ensure that someone is available to receive the delivery at the address provided. Redelivery fees arising from failed delivery attempts due to customer unavailability are for the customer’s account.

11.6 Risk of loss or damage to Products passes to you upon delivery to the delivery address specified in your Order.

11.7 Ownership of the Products passes to you upon receipt of full payment.

11.8 If your order is lost in transit, you must notify us within 7 (seven) days of the expected delivery date. Claims received after this period may not be honoured.


12. Bespoke and Custom Products

12.1 Bespoke Products are custom-formulated and manufactured to order based on your specific requirements.

12.2 Due to the bespoke nature of these Products, all bespoke orders are final and non-refundable once production has commenced, except where the Product is proven to be defective or does not conform to the agreed specification.

12.3 Bespoke orders are subject to a separate agreement detailing specifications, timelines, pricing, and any applicable minimum order quantities. In the event of conflict between that agreement and these Terms, the specific bespoke agreement shall take precedence.

12.4 Lead times for Bespoke Products will be communicated to you prior to order confirmation and payment.


13. Intellectual Property

13.1 All content on this Website, including but not limited to text, product descriptions, articles, images, photographs, logos, trademarks, graphics, and the Website’s design and layout, is the property of SYLK Skin or its licensors and is protected by South African and international intellectual property laws.

13.2 You may not reproduce, copy, distribute, republish, transmit, display, modify, or create derivative works from any content on this Website without our prior written consent.

13.3 Nothing in these Terms grants you any right, title, or licence in or to our intellectual property other than the limited right to use the Website for personal, non-commercial purposes in accordance with these Terms.

13.4 Feedback, suggestions, or ideas you submit to us may be used by us without restriction or compensation to you.


14. Prohibited Conduct

14.1 In using our Website, you agree that you will not:

  • Use the Website for any unlawful, fraudulent, or unauthorised purpose
  • Introduce any virus, malware, or harmful code to the Website
  • Attempt to gain unauthorised access to any part of the Website, our servers, or related systems
  • Use automated tools, bots, or scrapers to access, scrape, or extract data from the Website
  • Circumvent or interfere with any security or access controls on the Website
  • Post, transmit, or distribute any defamatory, offensive, or harmful content
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Use the Website to facilitate spam or unsolicited commercial communications
  • Purchase Products for the purpose of resale without our prior written consent

14.2 We reserve the right to suspend or terminate your access to the Website, cancel any pending Orders, and pursue any available legal remedies for breach of this clause.


15. Disclaimers and Limitation of Liability

15.1 Website availability: We do not warrant that the Website will be available at all times, free from errors, or uninterrupted. We may suspend, modify, or discontinue the Website at any time without liability.

15.2 Accuracy of information: While we take reasonable care to ensure that information on the Website is accurate and up to date, we make no representation or warranty, express or implied, as to the completeness, accuracy, or reliability of any information on the Website.

15.3 Medical and skin outcomes: SYLK Skin makes no warranty, express or implied, that any Product will produce a specific result or outcome for any individual customer. Skincare results are inherently variable and depend on individual skin types, conditions, and usage.

15.4 Limitation of liability: To the maximum extent permitted by law, SYLK Skin’s total liability to you for any loss or damage arising out of or in connection with your use of the Website or purchase of Products shall not exceed the amount paid by you for the specific Product giving rise to the claim.

15.5 Exclusion of consequential loss: We shall not be liable for any indirect, incidental, special, punitive, or consequential loss or damages, including loss of profit, loss of revenue, loss of data, or loss of goodwill, howsoever arising.

15.6 Consumer Protection Act: Nothing in these Terms limits or excludes any rights that you may have under the CPA that cannot lawfully be excluded. To the extent of any inconsistency between these Terms and the CPA, the CPA shall prevail in relation to Customers who are consumers as defined therein.


16. Consumer Protection Act Compliance

16.1 If you are a consumer as defined in the CPA, you enjoy the rights afforded to you under that Act, including but not limited to:

  • The right to receive goods that are of good quality, in good working order, and free of defects
  • The right to safe, good-quality goods
  • The right to fair, honest, and transparent dealing

16.2 These Terms are intended to operate alongside, and not to override or diminish, your statutory rights under the CPA.

16.3 In terms of section 49 of the CPA, we draw your attention to clauses 15 (Disclaimers and Limitation of Liability) and 19 (Dispute Resolution) as provisions that may limit your rights or impose risks upon you.


17. Electronic Communications

17.1 In accordance with the ECT Act, you agree to receive communications from us electronically, including order confirmations, invoices, shipping notifications, and policy updates.

17.2 Electronic communications sent by us to the email address registered on your account will be deemed received by you when delivered to your email server, regardless of whether you have read them.

17.3 You are responsible for maintaining an accurate and active email address on your account.


18. Governing Law and Jurisdiction

18.1 These Terms are governed by and construed in accordance with the laws of the Republic of South Africa.

18.2 Any dispute arising from or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts of South Africa.


19. Dispute Resolution

19.1 In the event of a dispute, you are encouraged to contact us in the first instance to seek an amicable resolution:

19.2 If a dispute cannot be resolved informally, either party may pursue the matter through the applicable South African court of competent jurisdiction, or through the National Consumer Commission if your complaint falls under the CPA.

19.3 Nothing in this clause prevents either party from seeking urgent interim relief from a competent court.


20. Force Majeure

SYLK Skin shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, civil unrest, strikes, government action, power outages, internet or telecommunications failures, pandemics, or acts of God. We will endeavour to notify you promptly of any such event and its expected duration.


21. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed from these Terms and shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.


22. No Waiver

Our failure to enforce any right or provision of these Terms on any occasion shall not constitute a waiver of that right or provision on any subsequent occasion.
